Acceptable Use Policy

We decline certain categories of work outright. Publishing that list saves everyone time and makes clear what kind of studio this is.

1. Why this policy exists

This policy sets out the work we will not undertake and the standards every client project must meet. It applies to all engagements and forms part of our Terms of Service.

Two reasons drive it. First, we will not build things that harm the people who end up using them. Second, as a business accepting card payments we are bound by US law and by the rules of the card networks and our payment processor, which prohibit servicing certain categories of business.

2. Work we do not accept

We do not design, build or maintain websites, brands or interfaces for:

Illegal activity

  • Anything unlawful under United States federal or state law, or under the law where the client operates.
  • Sale or distribution of controlled substances, prescription medication without valid authorisation, or drug paraphernalia.
  • Weapons, ammunition, explosives and their components.
  • Counterfeit goods, replica branded merchandise or pirated digital content.
  • Stolen goods, or data obtained without authorisation.
  • Human trafficking, forced labour or exploitation in any form.

Financial harm and deception

  • Pyramid schemes, Ponzi schemes, matrix programmes and multi-level marketing.
  • "Get rich quick" offers, guaranteed-return investment claims and unlicensed financial advice.
  • Cryptocurrency token sales, initial coin offerings and speculative token promotion.
  • Credit repair services promising to remove accurate negative information.
  • Debt collection, payday lending and high-cost short-term credit.
  • Any site whose commercial model depends on the customer misunderstanding what they are buying, including hidden recurring charges, dark-pattern checkouts and fake countdown scarcity.

Regulated and restricted categories

  • Gambling, betting, lotteries, casinos and games of chance played for money.
  • Adult content and adult services.
  • Tobacco, vaping products and cannabis, including CBD.
  • Unapproved health products, supplements making medical claims, and treatments claiming to cure disease.
  • Essay mills, exam-taking services and academic fraud.
  • Fake reviews, engagement farming and follower sales.

Harm and abuse

  • Content promoting hatred, violence or discrimination on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or age.
  • Harassment, doxxing, stalking tools and non-consensual surveillance or "stalkerware".
  • Malware, phishing kits, credential harvesting and tools designed to breach systems.
  • Deliberate disinformation, including impersonating a real organisation or public figure.

This list describes categories, not every conceivable case. We reserve the right to decline any project we judge to fall within its spirit, and we will tell you plainly and promptly if we do.

3. Standards for every project

For work we do accept, you agree that:

  • all content and materials you supply are lawful and either owned by you or properly licensed;
  • any claims made on the site are accurate and substantiable;
  • prices, subscription terms and cancellation methods are presented clearly to your own customers;
  • you hold any licence, registration or regulatory permission your industry requires; and
  • you comply with applicable privacy and consumer protection law, including publishing your own privacy policy and terms.

Where we build a site that takes payments, we will insist on clear pricing, a visible refund policy and a working contact route for your customers. That is not us being difficult — it is the minimum that payment processors require, and sites without it get shut down.

4. Sanctions and export controls

We do not provide services to individuals or entities located in, ordinarily resident in, or organised under the laws of any country or region subject to comprehensive United States sanctions, nor to any party designated on the US Treasury Department's Specially Designated Nationals and Blocked Persons list or any equivalent restricted-party list.

By engaging us you confirm that you are not such a person and that you will not use our deliverables in a manner that would breach applicable sanctions or export control law.

5. What happens if this policy is breached

If we discover during an engagement that a project falls within a prohibited category, or that material supplied to us breaches this policy, we will:

  1. contact you immediately and explain the specific concern;
  2. give you a reasonable opportunity to correct it, where correction is possible;
  3. suspend work if it is not corrected; and
  4. terminate the engagement under the Terms of Service if the breach is material or uncorrected.

Where an engagement is terminated for a breach of this policy, fees for work already performed remain payable and are not refunded. We may also be legally required to report certain activity to the relevant authorities.

6. Reporting a concern

If you believe a website we have built is being used in breach of this policy, tell us at legal@kelvane.org. Please include the URL and a description of the problem. We acknowledge every report within one business day and investigate promptly.
